Policeman's Annuity and Benefit Fund v. DV Realty Advisers, C.A. No. 7204-VCN (Del. Ch.), aff'd, No. 547, 2012 (Del. 2013)
Our firm, together with Baker & McKenzie, is representing the limited partners of a real estate investment fund in a statutory proceeding arising from the removal of the fund’s general partner. Following trial, the Delaware Court of Chancery held that the limited partners complied with the removal provisions of the limited partnership agreement and entered declaratory judgment in their favor removing the defendant general partner. The Court of Chancery's post-trial removal decision was affirmed on appeal by the Delaware Supreme Court.
