Fresenius Kabi USA, Inc. v. Watson Laboratories, Inc., (D. Del. 2014)

Ross Aronstam & Moritz, along with Knobbe, Martens, Olsen & Bear LLP, represented Watson Laboratories, Inc. and Actavis, Inc. in a two day bench trail concerning a generic product of Diprivan®, a propofol injectable emulsion product.  The judge tentatively ruled in Watson's favor from the bench following trail, and this ruling was upheld in the Court's trial opinion weeks later.
